Terms and Conditions of Use
BANG! Vertical Comics

Welcome to the Terms and Conditions of Use (the “Terms” or “T&Cs”) governing access to, browsing, and use of the services and features of the mobile application “BANG! Vertical Comics” (the “Application”).

The Application is operated, published and exclusively owned by SAS ARCTOON, with a share capital of €1,000, registered with the Paris Trade and Companies Register under number 930 845 367, whose registered office is located at 229 rue Saint-Honoré, 75001 Paris (“ARCTOON”).

Preamble

This page contains the Terms applicable to any connection and use of the Application by a User, which offers an online comic book broadcasting service.

By accessing and using the Application, each User expressly and unreservedly acknowledges and agrees to have read these Terms and that they govern the relationship with ARCTOON, to the exclusion of any other general terms. The use of the Application constitutes full and unreserved acceptance of the Terms.

In case of disagreement with any part of the Terms, the User must immediately refrain from using the Application.

ARCTOON reserves the right to modify the Terms at any time and without prior notice. The changes take effect immediately after the modified Terms are published on the Application.

All use of Users’ Personal Data is subject to the Privacy Policy.

Article 1 – Definitions

• Subscription : means the subscription taken out by the User on the Application, under the conditions described below, allowing access to the Application and Bang! Content.
  
• Application : refers to the mobile application published and operated by ARCTOON, and owned by ARCTOON.
  
• Third-party Stores : refer to third-party platforms such as Apple’s App Store or Google Play Store where in-app purchases related to the Subscription will be made by the User.
  
• Account : refers to the personal account created by each User to use the Application.
  
• Terms : refer to these Terms and Conditions of Use, which take effect from the date the User accepts them and continue until their termination in accordance with the conditions described herein.
  
• Bang! Content : refers to all information, works, and elements present on the Application (comics, catalog, texts, images, videos, algorithms, software, etc.) enabling its functioning, providing information to the User, and presenting services and features.
  
• User Content : refers to all information and elements related to the User that the User has chosen to integrate into their Account during the use of the Application (notably profile picture, comments, username, and other Personal Data).
  
• Personal Data : refers to any data that allows the direct or indirect identification of a natural person, such as first name, last name, email, login data, and is collected and processed by ARCTOON in accordance with the Privacy Policy .
  
• Reading Device : means a device enabling the downloading and/or viewing of Bang! Content, which may include, but is not limited to, any multimedia tablet or mobile phone.
  
• User : means a person registered on the Application.
  

Article 2 – Access, Registration to the Application, and Subscription

2.1. Account Creation

Each User must download the Application from a Third-party Store and create an Account. Users must be at least 18 years old. If the User is a minor, they must obtain prior consent from a legal guardian to use the Application. Parents or guardians are responsible for determining whether a service is suitable for their child(ren) and must supervise usage. ARCTOON will mark content that is not recommended for certain audiences. Comics are created by third-party authors who retain intellectual property rights; ARCTOON only makes them available and cannot be held responsible for their content, even if age indicators are not respected.

Users can create an Account electronically via Apple Sign Up or Google Sign Up by clicking the dedicated button.

After account creation, the User may access part of the Bang! Content selected by ARCTOON or choose to subscribe as described below.

By creating an Account, the User consents to ARCTOON collecting and processing their Personal Data per the Privacy Policy .

By clicking “start”, the User acknowledges acceptance of these Terms and declares having the skills to use the Application.

2.2. Subscription

Each User may subscribe to one of the various plans offered by ARCTOON to access the full Bang! Content catalog and offline reading features.

Subscriptions are available as in-app purchases through Third-party Stores only. Subscriptions are listed with current prices on the relevant App Store page and in device settings.

To subscribe, Users must begin with a free 3-day trial. If not canceled before the trial ends, it automatically converts into a paid subscription charged via the payment method set up on the Third-party Store.

By making an in-app purchase, the User authorizes ARCTOON, via the Third-party Store, to charge the selected plan per the chosen billing frequency (monthly or yearly).

Users already on a trial from Apple or Google will not be eligible for another free trial and will be charged immediately.

Subscription fees are based on factors such as estimated consumption of Bang! Content, licensing fees, Application maintenance, and promotional costs. ARCTOON does not include ads in its subscriptions.

By subscribing, the User fully accepts these Terms and acknowledges additional terms from Third-party Stores apply and are incorporated herein, including:

• The Terms are between the User and ARCTOON, not the Third-party Store providers. ARCTOON is solely responsible for the Application and its Content.
  
• ARCTOON is solely responsible for maintenance and warranties related to the Bang! Content.
  
• ARCTOON handles Personal Data requests and Application-related claims.
  
• The Third-party Store provider is a third-party beneficiary and may enforce these Terms.
  
• ARCTOON is not liable for services provided by Third-party Stores or telecom operators.

2.3. Subscription Renewal

Subscriptions renew automatically at the same price unless canceled before the current term ends. Deleting the Account or the Application does not cancel the Subscription. Users will be notified of any price changes and may cancel through their Third-party Store account.

2.4. Subscription Modification or Termination

To modify or cancel, Users must access their Third-party Store account. Upon cancellation, Users retain access until the end of the paid term. No prorated refund is given. All in-app purchase requests must go through the relevant Third-party Store.

2.5. Account Deletion

Users may delete their Account via the “Account” page in the Application. Deletion is immediate, but data removal may take time. Personal Data is handled per the Privacy Policy.  Re-registering with the same credentials within 30 days may reactivate the Account.

Deleting the Account does not cancel the Subscription — this must be done separately.

2.6. Lost or Forgotten Password

Users must follow the reset procedure via their Third-party Store account.

2.7. Miscellaneous

All costs related to accessing the Application (hardware, software, internet access) are the sole responsibility of the User, who is also responsible for ensuring their device functions properly.

Article 3 – Use of the Application

3.1. Personal Use

Users agree to use their Account and the Bang! Content for personal use only, in accordance with the Terms. Sharing the Account or allowing others to use it is prohibited.

Users agree not to infringe any intellectual property rights associated with the Bang! Content (especially comics owned by third parties). This includes not reproducing, transferring, or publicly communicating any part of the Bang! Content without prior written consent from ARCTOON or the rights holders.

In particular, Users agree not to reproduce Bang! Content, even partially, by any method (including screenshots) for any purpose.

Since third-party rights may apply, ARCTOON reserves the right to modify Content without justification or liability.

3.2. Confidentiality

Users must keep their login information, including Third-party Store credentials, confidential and not share them. ARCTOON is not responsible for unauthorized access due to negligence or information disclosure by the User.

3.3. Breach, Suspension and Termination

ARCTOON may unilaterally deny access to any User who breaches the Terms.

ARCTOON uses automated systems, user reports, and moderators to detect violations. It may suspend or terminate accounts, restrict access, or use legal/technical means as necessary.

Violating Users may be notified and reported to competent authorities. Provisions related to Personal Data and other surviving clauses will remain in force upon termination.

No refund will be provided for suspended or terminated Accounts that had paid services.

Users may appeal decisions within six months by contacting support@arctoon.xyz  with an explanation. They also have access to out-of-court dispute mechanisms and legal recourse.

3.4. Notifications

ARCTOON may send notifications about features, offers, products, or events. Users may opt in or out upon download. Settings can be changed later on the device or by contacting support@arctoon.xyz .

Article 4 – Authorization to Use Bang! Content

ARCTOON owns or licenses all elements of the Application, including structure, text, images, sounds, and videos. Comic authors retain their intellectual property rights.

Users are granted a limited, non-exclusive, non-transferable, non-sublicensable right to use the Application and Bang! Content during their Subscription period, for personal, non-commercial or commercial use — subject to compliance with the Terms.

Subscriptions confer no intellectual property rights.

Upon Account termination, this license ends automatically.

Users must not bypass technical protection measures or use Content in unauthorized ways.

Any unauthorized reproduction, representation, or exploitation is strictly prohibited and may be considered infringement under the French Intellectual Property Code.

Users shall indemnify ARCTOON against any claims arising from violations.

Article 5 – User-provided Information

Users are responsible for all data and content they upload. Users agree not to submit any information that:

• Violates laws (e.g., defamation, slander, restrictions on speech)
  
• Is illegal, false, or fraudulent
  
• Is unauthorized, exaggerated, inaccurate, or misleading advertising
  
• Promotes illegal, dangerous, violent, or discriminatory activities
  
• Contains viruses or technical elements that could damage the Application
  

Users shall indemnify ARCTOON from any resulting claims.

ARCTOON reserves the right to remove any User content without prior notice or justification.

ARCTOON may access, read, retain, or disclose User data as required by law, to investigate breaches, prevent fraud, address technical issues, or protect rights and safety.

Article 6 – Limitation of Liability

ARCTOON will make best efforts to ensure 24/7 access to the Application but cannot be held liable for any interruptions, regardless of cause or duration.

ARCTOON is not responsible for network/server failures or other events beyond its control that may limit access.

Access may be suspended at any time for technical, maintenance, security, or other reasons — without compensation.

ARCTOON offers Bang! Content via agreements with publishers and may modify or remove content at any time without liability.

Information on the Application may change without notice and is not guaranteed to be complete or accurate. User content is not vetted and remains the User’s responsibility.

User actions and data submissions are their own responsibility. ARCTOON is not liable for User behavior.

Internet data transmission may not be fully secure. While ARCTOON implements legal security measures, it cannot guarantee full protection. Data submission is at the User’s own risk (see Privacy Policy  for details).

ARCTOON is not responsible for damage to a User’s device due to security breaches, viruses, bugs, alterations, fraud, errors, or technical failures.

ARCTOON is not liable if the Application is incompatible with the User’s device or settings.

Article 7 – Protection Measures

Users acknowledge that Bang! Content may be protected by technical measures preventing unauthorized use.

Users do not acquire any intellectual property rights — only a limited right to view Content during their Subscription.

Bypassing protections or unauthorized use may constitute infringement and result in immediate Account termination, in addition to damages.

Article 8 – Miscellaneous

These Terms may be updated and represent the entire agreement between Users and ARCTOON, prevailing over any prior agreements or discussions — except the Privacy Policy.

Failure by ARCTOON to enforce any provision does not constitute a waiver.

No User may transfer any rights or obligations under these Terms without ARCTOON’s express consent.

Personal Data is collected and processed in accordance with the Privacy Policy.

Electronic communications between Users and ARCTOON may occur via the Application, by email at support@arctoon.xyz , or via in-app messaging. Users agree to receive legally valid communications in electronic form.

If any provision is deemed illegal or unenforceable, it will be removed without affecting the remainder of the Terms.

Article titles are descriptive only and have no effect on interpretation.

These Terms are governed by French law.

In case of difficulty, Users may contact customer service at support@arctoon.xyz .

If no resolution is found within one month, Users may submit the dispute to the CMAP (Centre de Médiation et d’Arbitrage de Paris)  at 39 avenue Franklin D. Roosevelt, 75008 PARIS, or cmap@cmap.fr  for independent mediation. Parties remain free to accept or reject the proposed solution and, if necessary, seek judicial recourse.
